Passenger Acknowledgement and Assumption of Risk
What every passenger should understand before travelling by boat, aircraft or car on Pickup, including the crew's safety authority, fitness to travel and the safety rules that apply.
Updated 2 November 2026 · 12 min read
Version 3.0. Effective 2 November 2026.
In short
- Travel by road, water and air carries risks that no checks, licences or insurance can remove completely.
- The captain, pilot in command and chauffeur have the final say on safety. Follow their instructions. On aircraft, weight, baggage, screening and dangerous goods rules are set by law and by the aircraft, and they are not negotiable.
- Tell the operator before you book about anything that affects your fitness to travel, such as pregnancy, a medical condition or reduced mobility. If you do not, and the operator declines to carry you, you may lose some or all of your payment under your cancellation option.
- On boats, everyone aboard, crew included, wears a life jacket at all times while aboard. Boat trips run in daylight only, and infants count towards capacity. Pickup does not control third party jetties and does not promise they are safe.
- Pickup is a booking platform. The operator and its crew run the trip. If you book for others, share this with them before the trip. You are responsible for your passengers on the booking.
- Emergency? Call 112. In-app safety features are secondary information tools and not an emergency response service.
- This is not a waiver. It does not remove liability for death, personal injury, gross negligence or fraud, or any right the law gives you that cannot be excluded.
This summary is for convenience only. The numbered clauses below govern.
1. About this acknowledgement
1.1 This Passenger Acknowledgement and Assumption of Risk ("Acknowledgement") is issued by Pickup Technology Limited, RC 9548096, Lekki Phase 1, Lagos State, Nigeria, trading as Pickup Charter ("Pickup", "we", "us").
1.2 It forms part of the Terms of Use and the Guest Terms. Words with capital letters have the meaning given in the Guest Terms. It applies to every Traveller on a Booking. The Booker must share it with every Traveller before the trip, as the booking for others section of the Guest Terms requires.
1.3 Shown before you book. For every boat and aircraft Booking, a summary of this Acknowledgement is shown prominently in the app before you pay, with a link to the full text, and you confirm you have read it. Your confirmation is recorded with the Booking. For car trips it is available from every Listing.
1.4 What it is for. This Acknowledgement explains the risks that come with travel itself, so that you can decide whether a trip is right for you and each Traveller, and tells you the safety rules you agree to follow. It is not a waiver of anyone's duty to take reasonable care, and it does not transfer to you any risk that arises from the negligence or breach of Pickup, an Operator or its crew (clause 9).
1.5 Each trip is provided by an independent, licensed Operator under a Charter Contract between the Guest and the Operator. Pickup does not carry passengers. The Operator and its Assigned Crew are responsible for the safe performance of the trip.
2. Inherent risks
2.1 You understand that travel by car, boat and aircraft carries inherent risks that remain even when everyone takes proper care, including:
(a) on the road: collisions caused by other road users, sudden braking, road and weather conditions, breakdowns, and delays caused by traffic, roadworks, flooding or security checkpoints;
(b) on the water: motion, sea sickness, spray, slips on wet decks, sun and heat, changes in weather and water conditions, wash from other vessels, floating debris, and the risks of boarding and leaving a vessel at a jetty or beach;
(c) in the air: turbulence, changes in cabin pressure, delays, diversions and technical faults found on safety checks, and the risks of moving around an apron and boarding an aircraft; and
(d) generally: illness or injury that may need medical care at a distance from a hospital, particularly on the water or abroad.
2.2 Verification by Pickup is a check of documents at a point in time. It is not a promise that a trip will be free of risk. See the verification section of the Guest Terms.
3. Fitness to travel and medical disclosure
3.1 Before you book, tell the Operator through the app about anything that may affect your safety or the safety of others on the trip, including pregnancy, a heart, lung or ear condition, recent surgery or diving, epilepsy, severe allergies, reduced mobility, an inability to swim (for boats), or a need for medical equipment or oxygen. We use this information only to pass it to the Operator for your trip, under the Privacy Policy.
3.2 The Operator, the captain or the pilot in command may decline to carry a Traveller, or ask for a medical clearance, where they reasonably believe the trip would put that Traveller or others at risk. The refund then depends on when the reason was disclosed:
(a) if it was disclosed before the Booking was confirmed and the Operator still confirmed, you receive a full refund, including card and bank processing costs;
(b) if it was not disclosed, or arose after confirmation, the Cancellation and Refund Policy applies as if you had cancelled when the Operator declined; and
(c) if the Operator declined without a genuine safety reason, it is the Operator's cancellation and you receive a full refund, including card and bank processing costs.
3.3 Private aircraft charter is not an air ambulance service. If you need medical care in flight, book a licensed air ambulance operator.
3.4 You must not travel if you are unwell in a way that could spread illness to others, or if you are under the influence of alcohol or drugs to a degree that affects your safety or behaviour.
3.5 Operators must accommodate reasonable assistance needs notified in advance and must not discriminate against a Traveller with a disability. A decision under clause 3.2 must be based on safety, not on disability alone. See the Nondiscrimination Policy.
4. The crew's safety authority
4.1 The chauffeur, the captain and the pilot in command are responsible for safety during the trip. Their safety decisions are final at the time they are made, including decisions to delay, change the route, return, divert, refuse boarding or end a trip.
4.2 You must follow safety instructions and briefings given by the crew, including seatbelt instructions, the safety briefing on boats and aircraft, and instructions in an emergency.
4.3 If you think a safety decision was wrong, comply first and raise it afterwards through the Dispute Resolution process. It will be reviewed by a person in our team, and any refund is decided on the evidence.
5. Cars
5.1 Every car trip is chauffeur driven. No Traveller may drive.
5.2 Every Traveller wears a seatbelt. Children use a child seat or restraint where the road traffic rules require it. Ask for a child seat as an Extra when you book.
5.3 The chauffeur follows the road traffic laws and the legal limits on driving time and rest. Long days include breaks. A rest stop the law or safety requires is not a breach of the Charter Contract.
5.4 The chauffeur may refuse a route, stop or speed that is unlawful or unsafe, including travel outside the area of operation on the Listing.
6. Boats and yachts
6.1 Every person aboard, Travellers and crew alike, wears a properly fitted life jacket at all times while aboard, including on deck and in any tender. This is Pickup's rule and applies in addition to the life jacket rules of the Lagos State Waterways Authority (LASWA), the National Inland Waterways Authority (NIWA) and NIMASA. Life jackets for the full certified capacity, including child sizes when you have told the Operator a child is travelling, are carried on every vessel listed on Pickup.
6.2 Boat trips run in daylight only: departure after sunrise and return before sunset. Every boat trip must start and end within the daylight window shown in the app. Operators cannot offer night trips on Pickup and cannot switch this rule off, and must also follow any restriction on night movement set by the waterways authorities.
6.3 The number of people aboard, including children and infants, must never exceed the vessel's certified capacity. The captain will refuse to depart if it does.
6.4 The captain may delay departure, change the area of operation, return early to stay within daylight hours, or decline to sail because of weather, water conditions, a directive of LASWA, NIWA or NIMASA, or another safety reason.
6.5 Swimming, diving and water activities take place only where the captain allows them, at your own risk as to the inherent risks of the activity, under the captain's instructions, and never after drinking alcohol.
6.6 Board and leave only at the jetty or berth in the Booking, unless the captain changes it for safety. Many jetties and marinas are run by third parties. Pickup does not control them and does not promise they are safe. Take care when boarding, and report a boarding point that looks unsafe to the captain and to us.
7. Aircraft
7.1 Weight and balance limits, baggage allowances and seating are set by the aircraft and the Operator's Air Operator's Certificate. Everyone aboard, including infants, counts towards the aircraft's certified capacity. You must give accurate passenger and baggage weights when asked. The pilot in command may refuse to carry passengers or baggage that would exceed the limits.
7.2 Travellers and their baggage are subject to security screening. Nigeria Civil Aviation Authority (NCAA) and aviation security screening is absolute on every jet segment, including for on duty security personnel. Weapons and dangerous goods must not be carried except as aviation law allows. See the Weapons and Prohibited Items Policy.
7.3 You must carry valid identification, and for an international flight a passport valid for at least 6 months after the flight and any visa or health documents the destination requires. The Operator may refuse boarding without them. Only Travellers on the approved passenger manifest may board.
7.4 Departure and arrival times are planned, not guaranteed. Weather, air traffic control, airspace restrictions, technical checks or a directive of the NCAA or another authority may delay or divert a flight. An Empty Leg also depends on the Operator's main charter and its time may move within the departure window shown on the Listing.
8. Alcohol, children and belongings
8.1 Where alcohol is served or allowed by the Operator, you must drink responsibly. The crew may stop serving alcohol, refuse boarding or end a trip where a Traveller's behaviour puts anyone at risk. Alcohol is never served to anyone under 18. See the Zero Tolerance Policy.
8.2 Children under 18 travel only on a Booking made by an adult with a responsible adult Traveller aboard for the whole trip. Unaccompanied minors are never carried.
8.3 The responsible adult must make sure children use an appropriate child seat or restraint in cars where required, wear a child sized life jacket on boats, and follow the crew's instructions.
8.4 Keep valuables with you. Report anything left behind through the lost items option on the trip. The Operator holds a found item for 30 days and Pickup helps arrange its return, at the owner's cost; after that an unclaimed item may be donated or lawfully disposed of, except that cash, identity documents and valuables are handed to the police. The Operator is responsible for loss of or damage to your belongings only where it or its crew caused it.
9. What this does not change
9.1 Nothing in this Acknowledgement excludes or limits:
(a) liability for death or personal injury, including from any failure by Pickup to carry out the Verification it promises in the Guest Terms;
(b) liability for fraud or fraudulent misrepresentation, or for gross negligence or wilful misconduct;
(c) any right, remedy or guarantee you have under the Federal Competition and Consumer Protection Act 2018, the Civil Aviation Act 2022 or any other law that cannot be excluded or limited, including any mandatory consumer rights of the country where you live; or
(d) the Operator's obligation to provide the trip with reasonable care and skill, and to hold the licences and insurance its service requires.
9.2 Pickup does not sell insurance. Transport is provided by independent licensed Operators who hold their own commercial cover, and Pickup checks the documents. You can ask the Operator for its policy details before the trip, and decide whether to arrange your own travel or personal accident insurance.
9.3 Claims for injury, loss or damage during a trip are made first against the Operator and its insurer. Pickup will share the Booking records it holds to support a claim, and after an injury or severe property damage, the Operator's insurance certificate details. See Insurance Information and Dispute Resolution.
10. Changes, law and contact
10.1 We may update this Acknowledgement. A material change is notified at least 30 days in advance in the app and by email; a change required by law or made for safety takes effect immediately. You accept a new version as the Guest Terms describe, or you may close your Account instead. A change does not apply to a Booking already confirmed, unless required by law or for safety.
10.2 This Acknowledgement is governed by the laws of the Federal Republic of Nigeria, subject to any mandatory consumer law of the country where you live. Disputes are resolved under the Complaints and disputes section of the Guest Terms. Notices to Pickup are given by email to legal@pickupltd.com.
10.3 Questions: in app support, or support@pickupcharter.com.
10.4 In an emergency, call 112. In-app safety features are secondary information tools and do not constitute an emergency response service. Pickup does not guarantee continuous, uninterrupted live monitoring, and automated prompts do not shift emergency response duties away from public authorities. In an emergency, call 112.
