Crew Terms & Conditions
The terms for chauffeurs, captains, boat crew, flight crew and handlers who join Pickup Charter through an operator. Pickup does not employ you; your operator does.
Updated 2 November 2026 · 32 min read
Version 3.0. Effective 2 November 2026.
In short
- You work for your Operator, not for Pickup. Your Operator assigns your trips, pays you and decides your hours. Pickup does not employ you, pay you or decide what you earn. You may work for more than one Operator.
- You join by invitation and verify before your first trip. Sign-in codes come by email only. If a required document expires, your crew access is suspended automatically until the renewal is verified.
- Assigned trips only. No substitutes, no street hails, no cash. Never sell, price or take payment for extras. A trip starts on its own at the booked time (jets: at wheels up), unless the ID check it needs is not on file.
- Safety first. Zero alcohol or drugs on duty. No more than 5.5 hours of continuous driving and 10.5 hours of driving in any 24 hours, across every Operator. Never exceed certified capacity, and infants count on boats and jets. Boats run in daylight only, and everyone aboard, crew included, wears a life jacket at all times on deck and in any tender. You may refuse anything unsafe or unlawful. In an emergency, call 112.
- Your phone number and live location are shared only from 1 hour before the trip starts until 1 hour after it ends.
- Leaving. You can leave an Operator in the app at any time, and your upcoming trips go back to it. You can delete your crew account once every trip is finished.
- Limits and disputes. Pickup's liability to you is capped at the greater of any Pickup fees you paid in the 12 months before the claim and ₦100,000, except for death, personal injury, gross negligence, fraud or anything the Federal Competition and Consumer Protection Act 2018 does not allow us to exclude. Disputes with Pickup go to support first, then final individual arbitration at the Lagos Court of Arbitration. You can opt out of arbitration by email within 30 days of first accepting. No class claims. Pay and employment questions stay with your Operator.
This summary is for convenience only. The numbered clauses below govern.
1. About these terms
1.1 Parties. These Crew Terms are between Pickup Technology Limited (RC 9548096), Lekki Phase 1, Lagos State, Nigeria, trading as Pickup Charter ("Pickup", "we", "us"), and you, an individual invited by an Operator to perform Charter Services ("you").
1.2 Who these terms cover. Chauffeurs; captains, coxswains, boat masters, deckhands, stewards and hosts; and pilots, first officers, cabin crew and ground handlers; each added to the Platform by an Operator as authorised crew ("Authorised Crew").
1.3 Personal acceptance. You must accept these Crew Terms yourself, in your own account, before your first assignment. Your Operator cannot accept them for you. At sign up there are two required boxes, both unticked. The first reads: "I am 18 or over and I agree to the Terms of Service, the Privacy Policy, the Dispute Resolution terms and the Crew Terms." The second reads: "I have read the Privacy Policy and understand how Pickup and my operator use my personal data, ID and live location on trips." We record your user ID, the document and its version, the date and time, the app version, the IP address and the device used. You accept every new version in the same way before your next assignment, on the "We've updated our terms" screen when you next open the app. A ticked box while signed in to your account is your electronic signature under section 93 of the Evidence Act 2011, and the electronic record may be produced in evidence under section 84 of that Act, with any certificate it requires.
1.4 Other documents. These policies also apply to you, and each is part of these Crew Terms as it applies to crew: the Terms of Use, Community Standards, Acceptable Use Policy, Off Platform Booking Policy, Reviews & Ratings Policy, Zero Tolerance Policy, Weapons and Prohibited Items Policy, Nondiscrimination Policy, Service Animal Policy, Tips Policy, Content Policy, Verification and Compliance, Dispute Resolution and Privacy Policy. If one of them conflicts with these Crew Terms on a matter about crew, these Crew Terms govern.
1.5 Definitions. Capitalised words not defined here have the meaning in the Guest Terms and the Operator Agreement. "Trip Window" means the period from 1 hour before a trip's booked start time until 1 hour after the trip ends.
2. Your relationship with Pickup and your Operator
2.1 Pickup does not employ you. Nothing in these Crew Terms, and nothing Pickup does under them, makes you an employee, worker, agent, partner or joint venturer of Pickup, or makes Pickup your employer or joint employer. Pickup does not hire you, pay you, set or recommend your wages, share in your earnings, schedule your hours, roster you, issue you uniforms or equipment, discipline you, or supervise how you drive, sail or fly. These Crew Terms are not a contract of employment and do not create a contract of service with Pickup.
2.2 Your Operator engages you. You are engaged by your Operator, whether as its employee or as its contractor, on terms agreed between you and it. Your Operator controls hiring, your pay, your shifts and whether to accept a trip. It is solely responsible for your pay, deductions and taxes, pension contributions, any contribution under the Employee's Compensation Act 2010, any insurance the law requires for you, your working hours, rest, training, supervision, discipline and welfare. Any dispute about your pay or engagement is between you and your Operator.
2.3 No obligation to accept, no exclusivity. Pickup does not require you to work any minimum number of trips or hours, and does not offer or allocate work to you. Assignments come only from your Operator. You are free to work for other operators, platforms or clients, subject to the Off Platform Booking Policy for Guests you meet through Pickup.
2.4 More than one Operator. Your account may be linked to more than one Operator. Add one with the invite from its email. Your verified ID and documents are shared with each Operator you join, so nothing is uploaded twice. Each trip is performed for the Operator that assigned it, and that Operator alone is responsible for you on that trip. Each Operator sees only its own trips, along with your total trip count and your rating on Pickup. You must not accept assignments that overlap in time, or that together would take you over the driving, duty or rest limits in clause 6. You count all your work, on and off the Platform and for every Operator, towards those limits.
2.5 What Pickup does. Pickup runs the Platform. It verifies your identity and licences, shows your details to Guests as clause 4.6 describes, records trips, collects Guest payments as the Operator's limited payment collection agent, and provides support. The standards in these Crew Terms are conditions for using the Platform and safety rules the law already sets. They are not instructions from an employer.
2.6 No control. Pickup does not agree to control, direct or manage you or any vehicle, vessel or aircraft. For cars in Lagos, this includes within the meaning of the 2023 Lagos Regulation (defined in clause 3.2), which provides that a service entity is not deemed to control, direct or manage vehicles or drivers unless it agrees to do so in writing. Pickup gives no such agreement.
2.7 Your Operator's responsibility for you. Your Operator remains responsible to Guests and to Pickup for your acts and omissions on a trip. The Operator Agreement requires your Operator to engage you lawfully and to answer for any claim that you are Pickup's employee.
2.8 Insurance. Pickup checks Operators' insurance documents but does not sell insurance, and it does not provide or arrange insurance for you, for Guests or for any vehicle, vessel or aircraft. Your Operator holds its own commercial insurance and is responsible for any insurance the law requires for you. Ask your Operator if you want details. See Insurance Information.
2.9 Raising concerns directly. If you have a concern about your treatment, including unpaid wages, excessive hours, retention of your identity documents, being asked to pay a fee to get work, or pressure to work unsafely, you can report it to Pickup directly at legal@pickupltd.com or through crew support, without going through your Operator. We treat it confidentially as far as the law allows. Your Operator must not retaliate against you for making a report in good faith. Where a report suggests forced labour or exploitation, we may suspend the Operator and refer the matter to the authorities, as our Modern Slavery Statement explains.
3. Eligibility
3.1 Everyone. You must:
(a) be at least 18 years old, or older where your role requires (clause 3.2); (b) be legally entitled to work in the country where you perform trips; (c) hold a valid means of identification, including your NIN for trips in Nigeria; and (d) hold, for your whole time on the Platform, every licence, certificate and medical certificate the law requires for your role, the vehicle, vessel or aircraft and the place of the trip.
3.2 Chauffeurs. You must be at least 21 years old. For car trips in Lagos, the Amended Regulation for On-line Hailing Business and Taxi Cab Operation in Lagos State (2023) (the "2023 Lagos Regulation") also requires a driver to be a citizen of Nigeria and literate, to carry the driver's badge at all times while driving once it is held, and never to solicit or accept a street hail. Pickup applies those standards to car trips in Lagos as its own. Your Operator warrants to us that you meet them, and we may ask you or your Operator for evidence at any time.
3.3 Captains and vessel crew. Certificates of competency must be for the vessel's size, type and waters, issued or recognised by the Nigerian Maritime Administration and Safety Agency (NIMASA). Deckhands and other vessel crew need the certificates the vessel's safe manning and the waters require, including basic safety training where the law requires it.
3.4 Pilots, flight crew, cabin crew and handlers. Charter flights booked on Pickup are operated only by Operators that hold a current Air Operator's Certificate (AOC) issued by the Nigeria Civil Aviation Authority (NCAA), with the aircraft listed on the AOC holder's operations specifications. You fly only under that AOC. Pilots also need the recency, proficiency checks and line checks the Operator's NCAA-approved procedures require, and cabin crew need current training under the Operator's approved programme. Handlers need any airport or airside authorisation the airport operator and ground handling company require. Your Operator, as AOC holder, remains responsible for your rostering, training and currency under NCAA supervision.
3.5 Tell us about changes. You must tell us and your Operator in the app, within 24 hours, about any suspension, restriction, endorsement or withdrawal of your licence or medical certificate, any criminal charge or conviction relevant to your role, and any medical condition or medicine that affects your fitness to operate. You must not perform a trip while any of these affects your fitness or entitlement to operate.
4. Account, sign-in and verification
4.1 Joining. Your Operator invites you by email. Accept the invitation in the Pickup app, using the email it invited. If you already book on Pickup with that email, crew is added to the same account and your guest ID check carries over. You hold one account in your own name. Never share it, lend it or let anyone else use it.
4.2 Codes by email only. Sign-in codes are sent by email only. Pickup never asks you for a sign-in code by phone, SMS or WhatsApp. Never share a code, including with your Operator.
4.3 What we check.
| Role | Before your first trip | Can follow later |
|---|---|---|
| Chauffeur | ID check; FRSC national driving licence valid for the vehicle class; photo; your Operator's confirmation that you work for it and may drive its vehicles | LASDRI certificate of competence and card, driver's badge, LASRRA card |
| Captain or coxswain | ID check; NIMASA certificate of competency; seafarer medical fitness certificate; photo | Any licence or permit the Lagos State Waterways Authority (LASWA) requires on Lagos waters, or the National Inland Waterways Authority (NIWA) on federal inland waterways |
| Deckhand, steward or host | ID check; seafarer medical fitness certificate; photo | |
| Pilot or first officer | ID check; NCAA licence (ATPL or CPL, or an NCAA validation of a foreign licence); Class 1 medical certificate; type rating for the aircraft; photo | |
| Cabin crew | ID check; cabin crew attestation; medical certificate; photo | |
| Handler | ID check; FAAN airside pass for the airport you work | Passes for other airports |
Documents in the last column become required on the date we give you by notice in the app, which is at least 30 days ahead unless the law, the Lagos State Ministry of Transportation or another regulator requires them sooner. Pickup staff approve you before you can be assigned.
4.4 The ID check. You choose one of two routes:
(a) Automated check. Our verification provider, Dojah, matches your selfie with your NIN record. That face match is biometric, so we ask for your separate consent in an unticked box first. You get up to 3 tries. (b) Manual review. You upload two photos: your ID, and you holding your ID. Trained staff look at them. No face matching software is used and no template is made.
Most reviews finish within 24 hours. Some take up to 3 working days. If a check fails, we tell you why and how to fix it, and we tell your Operator. Verification is a check for the Platform at a point in time. It does not certify that you are fit or licensed to operate. That remains your responsibility and your Operator's. We may ask you to verify again at any time, including before a trip.
4.5 Expiry. We remind you 30 days and 7 days before a document expires, and we tell your Operator. If a required document expires without a verified renewal, your crew access is suspended automatically until the renewal is verified, and your Operator cannot assign you. Upload the renewal in the app.
4.6 What Guests see. If you are a chauffeur, Guests see your name and photo before the trip, and are told if the chauffeur changes. Boat and flight crew are shown to Guests by role only (for example "your captain" or "your flight crew"), never by name or photo. Guests never see your ID or documents.
4.7 Truthfulness. Submitting a false, forged or altered document ends your access permanently and may be reported to the authorities.
5. Performing trips
5.1 Assigned trips only. You may perform only trips your Operator has assigned to you in the app. Never send someone else in your place and never perform a trip assigned to someone else. If you cannot make a trip, tell your Operator early in the app so it can reassign it to verified crew. Pickup does not offer a second or relief chauffeur.
5.2 Before you leave. Tap "I'm on my way" when you set off and "I've arrived" when you arrive. The Guest sees your progress live.
5.3 Trip start. No code is used. A car or boat trip starts automatically at its booked start time, unless the ID check the Booking needs is not on file. A flight starts at wheels up, which you record in the app, and ends when you record the landing. Never ask a Guest for a code. Never let a trip be recorded as started when it is not taking place.
5.4 Phone numbers and messages. Your phone number and the Guest's are visible to each other, and you can message the Guest in the app, only from 1 hour before the trip starts until 1 hour after it ends. Outside that window, your Operator or Pickup support handles contact.
5.5 Right Guest. Confirm you have the right Guest from the Booking details in the app. For boats, check Guests against the guest list and give the safety briefing before leaving the jetty. For flights, check each passenger's passport or ID against the approved manifest before boarding. Only passengers on the approved manifest may board.
5.6 Guest not here. If the Guest does not arrive, mark that you have arrived and try them through the app. From 60 minutes after the booked start (or, on an airport pickup, after the flight's landing), you or your Operator may record a no show in the app.
5.7 No street hails. Never solicit or accept a street hail, pick up passengers not on the Booking, or wait at taxi ranks or jetties for passengers.
5.8 Capacity. Never carry more people than the certified capacity recorded for the vehicle, vessel or aircraft, or more weight than its limits allow. Infants count toward the limit on boats and jets.
5.9 Route and schedule. Follow the Booking. Choose the safest reasonable route on the day. Deviate only at the Guest's lawful request, or for safety.
5.10 Extras and extensions. You never sell, price, promise or take payment for extras or extra time. Guests add extras at booking, or ask the Operator in the app for a quote, and pay for them in the app. You see the extras on the trip in the app and deliver what is booked. If a Guest asks you for an extra or for more time, ask them to request it from the Operator in the app. More time starts only when your Operator accepts the extension in the app.
5.11 Close the trip. End the trip accurately in the app.
5.12 Breakdowns. Stop somewhere safe and report it in the app. Your Operator decides what happens next, and Pickup works out any refund.
5.13 Lost items. After each trip, check for items left behind. Log anything you find in Help > Found item the same day, and hand it to your Operator. The Operator holds found items for 30 days while Pickup helps the owner arrange their return, at the owner's cost. Cash, identity documents and valuables that are not collected are handed to the police. Other items are then donated or disposed of lawfully. Never keep a found item.
6. Safety and the law
6.1 Alcohol and drugs. You must not consume alcohol, or any drug or medicine that may impair you, before or during a trip, and you must not be on duty with any alcohol or illegal drug in your system. Flight crew must also observe the NCAA rules and any stricter Operator rule on alcohol before duty. You must take part in any lawful test your Operator, an airport or a regulator requires. A credible report that you were impaired on duty leads to immediate suspension while we investigate, as the Zero Tolerance Policy explains.
6.2 Driving hours (chauffeurs). You must not drive for more than 5.5 hours continuously or 10.5 hours in any 24 hours, across every Operator, under the Lagos State Transport Sector Reform Law 2018, as listed in the 2023 Lagos Regulation. Any limit that applies outside Lagos, and any stricter limit your Operator sets, also applies. The app counts the hours you are assigned and will not let an Operator assign you over the daily limit, but you remain responsible for the limits. Take the breaks your Operator plans on a long Booking. If continuing would break a limit, stop at a safe place and tell your Operator in the app.
6.3 Duty and rest (vessel and flight crew). Captains and vessel crew must observe the hours of work and rest the law and the Operator's safety procedures set. Flight crew must observe the flight time, duty period and rest limits in the Operator's NCAA-approved scheme.
6.4 Fitness. Do not accept or continue an assignment if you are too tired, unwell or otherwise unfit to perform it safely. Telling your Operator you are unfit is never a breach of these Crew Terms.
6.5 Road, water and air law. You must comply with all road traffic, inland waterways, merchant shipping and civil aviation law that applies to your trip, including the Federal Road Safety Commission (Establishment) Act 2007 and the National Road Traffic Regulations, the Merchant Shipping Act 2007 and NIMASA rules, LASWA rules on Lagos waters, and the Civil Aviation Act 2022 and Nigeria Civil Aviation Regulations.
6.6 Boats. Boat trips run in daylight only: departure after sunrise and return before sunset. Operators cannot switch this off, and night trips are not offered on Pickup. Every person aboard, including the captain and crew, must wear a life jacket at all times on deck and in any tender. Give the safety briefing before departure, and make the weather call in the app by the time shown. The captain has final authority on board on every matter of safety, and may delay, shorten, divert or cancel a sailing for weather, water conditions, a regulator's directive or any other safety reason. Many jetties are run by third parties. Pickup does not control them and does not promise they are safe. Tell your Operator and the Guests of any hazard you see at a boarding point.
6.7 Aircraft. The pilot in command has final authority over the flight, and over who and what is carried, under the Operator's AOC and NCAA regulations. No request from a Guest, the Operator's sales staff or Pickup overrides it. Record the weather briefing in the app.
6.8 Right to refuse. You may refuse any request that is unlawful or unsafe, including exceeding capacity, carrying a prohibited item, a boat movement outside daylight hours, or operating outside a licence, and you may end a trip if safety requires it. Report it in the app. Pickup does not penalise you for a refusal made in good faith on safety or legal grounds.
6.9 Weapons and security. No armed escorts are arranged through Pickup, and you must never arrange or offer police escorts or armed security. Any security add on is supplied unarmed, by a private guard company licensed by the Nigeria Security and Civil Defence Corps, through your Operator. You must never carry a firearm or other weapon on a trip. A Guest may travel with lawfully assigned, on duty security personnel if your Operator consents. On duty state security officials lawfully authorised to carry are an exception to the Weapons and Prohibited Items Policy. NCAA and aviation security screening stays absolute on every jet segment.
6.10 Incidents and safety features. The app has emergency contact alerts, and Guests on car and boat trips get an "Are you OK?" check-in after a stop of 15 minutes. If a Guest does not answer, the safety team sees it. In-app safety features are secondary information tools and do not constitute an emergency response service. Pickup does not guarantee continuous, uninterrupted live monitoring, and automated prompts do not shift emergency response duties away from public authorities. In an emergency, call 112. Then report any incident, accident or safety concern in the app as soon as it is safe to do so, and cooperate with your Operator, Pickup and the authorities.
7. Conduct
7.1 Professional standards. Treat every Guest and Traveller with courtesy and respect. No harassment, discrimination, intimidation or violence. Follow the Community Standards.
7.2 Accessibility. Help Guests with notified assistance needs where you safely can. Never refuse or mistreat a Guest because of disability. Carry a Guest's assistance animal as the Service Animal Policy requires, and follow the Nondiscrimination Policy.
7.3 Privacy of Guests. Use Guest information only to perform the trip. Never copy, keep, share or use it to contact a Guest outside the Platform. Do not photograph or record Guests without their consent. Keep what you see and hear on a trip confidential, unless the law requires you to disclose it.
7.4 Communication. Keep all messages with Guests in the app, where they are recorded.
7.5 Cameras. An Operator may use a camera inside a vehicle or vessel only if the Listing discloses it and a visible notice is shown on board. No audio is recorded without a separate notice. Footage is kept for 30 days unless it is needed for a case, and is never published. The Nigeria Data Protection Act 2023 applies to footage of you as it does to footage of Guests. Never switch off, cover or move a disclosed camera, and never use your own device to record a Guest.
8. Payments
8.1 No cash, no side payments. Guests pay only through the Platform. You must never ask for or accept cash, transfers or any payment outside the Platform, including for waiting, fuel, tolls, extensions or extras. The Platform does not offer tipping. You must never ask a Guest for a tip. You may accept a tip a Guest offers unprompted, as the Tips Policy describes, and you must treat every Guest the same whether or not they tip.
8.2 Your pay comes from your Operator. Pickup pays Booking money to your Operator's company account by transfer, never to you. Pickup does not see your pay, is not responsible for paying you and does not guarantee that your Operator pays you.
9. Your data and location
9.1 What we process. We process your identity, contact, licence and medical certificate details, verification results, trip records, location in the Trip Window and messages, as the Privacy Policy describes, under the Nigeria Data Protection Act 2023 (NDPA) and the General Application and Implementation Directive 2025 (GAID). We do this to perform these Crew Terms, to meet our legal and regulatory duties, and for our legitimate interest in keeping trips safe and preventing fraud.
9.2 ID check data. The face match in the automated check is biometric data, which the law treats as sensitive. We ask for your separate, explicit consent before we process it, and you can choose manual review instead (clause 4.4). You can withdraw consent in Profile > Security > Identity check, or through Help, or by email to privacy@pickupltd.com. ID files are open only to Trust and Safety and Compliance staff, and every opening is logged. Pickup does not use ID images, selfies, face templates, message content or precise location to train any model. Automated checks never decide alone: apart from the automatic suspension for an expired document, a person reviews any check that would refuse or suspend you.
9.3 Location. The app shares your live location with the Guest and your Operator, and with Pickup's safety staff, only within the Trip Window (from 1 hour before a trip starts until 1 hour after it ends). Pickup records it only within the same window, to keep an accurate trip record. It is never shared earlier, and we do not track your location when you are not on an assigned trip, or between trips. The app tells you before it asks for permission.
9.4 Who sees it. We share your name and photo with Guests on your car trips, your role only on boat and jet trips, your verification status, documents and trip data with the Operators you work for, and data with regulators and competent authorities where the law requires, as our Law Enforcement Requests policy explains. Your Operator is an independent controller of the data it holds about you, and must protect it under the same law. Our service providers, and the countries where they hold data, are listed in Sub-processors. Data is stored outside Nigeria with Supabase and Vercel, and transferred only on a basis the NDPA allows, such as standard contractual clauses or adequate protection.
9.5 Lagos Ministry reporting. Pickup has applied for the Lagos State Service Entity Permit in the car rental (chauffeur hire) category. From the date it is granted, Pickup gives the Lagos State Ministry of Transportation, weekly and monthly, the chauffeur, vehicle, trip and accident data the 2023 Lagos Regulation lists. If you are a chauffeur, your data is shared in this way because the law requires it. The Regulation records the Ministry's undertaking to keep that data confidential.
9.6 Your rights. You have rights over your data, including access, correction, deletion where the law allows, objection, withdrawing consent and complaining to the Nigeria Data Protection Commission (NDPC), as the Privacy Policy explains. Email our Data Protection Officer at privacy@pickupltd.com to use them.
9.7 How long we keep it. Raw location: 30 days after the trip, unless an open case or a legal hold needs it. Selfies and face templates: 30 days after the identity decision, or 7 days after you withdraw consent. ID document records and anti money laundering records: 5 years after you leave the Platform. Financial records, booking ledgers and tax invoices: 5 years. In app messages: 2 years. Support cases and disputes: 6 years after they close. A legal hold, a regulator's request or a live claim overrides these periods.
9.8 Data breaches. If a personal data breach affects your data, we notify the NDPC within 72 hours of becoming aware of it, and tell you without undue delay where the risk to you is high.
9.9 Your acknowledgement. By accepting these Crew Terms you confirm that you have read the Privacy Policy and understand how your data, including your location in the Trip Window and, for chauffeurs in Lagos, the Ministry reporting, is used.
10. Reviews
Guests review the trip, and the review includes a score for the chauffeur or crew. Your rating and what Guests said show in your profile, and the Operators you work for see your rating. Guests may also leave compliments for the team. You do not review Guests. Your Operator may. A review must not name or identify boat or jet crew. If a Guest's conduct concerns you, report it in the app: safety and conduct reports go to Pickup's trust and safety team. If a review breaks the Reviews & Ratings Policy, tell Pickup support. Never ask a Guest for a particular rating or retaliate for one.
11. Suspension and removal
11.1 Suspension or removal by Pickup. Pickup may suspend or remove your access to the Platform at once where it reasonably believes you have breached these Crew Terms, a safety risk exists, a document is invalid or false, there is fraud, or the law or a regulator requires it. Automatic suspension on document expiry is described in clause 4.5, and ends when the renewal is verified. Pickup may also end your access for any other reason on 30 days' notice in the app and by email.
11.2 Reasons and review. Suspension while we investigate is not a finding of wrongdoing. We tell you the reason unless the law prohibits it or it would prejudice an investigation or someone's safety. You can respond, and you can ask for a review by a person who did not make the original decision, by writing to support@pickupcharter.com within 30 days. The review is decided within 14 days of your request.
11.3 Platform only. Removal from the Platform affects only your use of the Platform. It is not a decision about your employment or engagement, which is a matter for your Operator.
11.4 Removal by your Operator. Your Operator may remove you from its crew at any time. Your access to that Operator's trips ends when it does. Your link to any other Operator is not affected.
12. Leaving and deleting your account
12.1 Leaving an Operator. You can leave an Operator in the app at any time. Your upcoming trips with it go back to it to reassign, and it is told. Your documents stay checked, and your link to any other Operator is not affected.
12.2 Deleting your crew account. You can delete your crew account in the app once every trip is finished. An upcoming trip, however far ahead, blocks it until the trip is finished or your Operator takes you off it. You confirm with a code we email you. Every Operator you work for is told and loses you from its crew. Trip records stay, as clause 9.7 describes. Your guest account stays open.
12.3 Deleting your guest account too. To remove everything, close your crew record first, then delete your guest account in Profile > Security > Delete my account, as the Privacy Policy describes. That needs the emailed code and typing DELETE, takes effect at once and cannot be undone.
13. Liability
13.1 What is never limited. Nothing in these Crew Terms limits or excludes liability for death, personal injury, gross negligence, fraud or wilful misconduct, or anything the Federal Competition and Consumer Protection Act 2018 does not allow Pickup to exclude, or any other liability that cannot lawfully be limited or excluded.
13.2 Subject to clause 13.1, Pickup is not liable to you for loss of earnings, profit or opportunity, or any indirect or consequential loss, arising from your use of the Platform or its suspension, and Pickup's total liability to you is limited to the greater of any Pickup fees you paid in the 12 months before the claim arose and ₦100,000.
13.3 Your Operator's acts. Pickup is not responsible for your Operator's acts or omissions, including any failure to pay you, insure you or keep you safe at work.
13.4 Your responsibility. You are responsible for loss you cause through fraud, wilful misconduct or deliberate breach of these Crew Terms.
14. Disputes and governing law
14.1 Support first. Raise any concern first through crew support in the app. We aim to reply within 2 business days. Either of us may propose mediation at the Lagos Multi-Door Courthouse. Mediation is voluntary.
14.2 Mandatory individual arbitration. Any dispute between you and Pickup arising out of or in connection with these Crew Terms or your use of the Platform that is not resolved within 30 days of being raised must be referred to final and binding arbitration under the Arbitration and Mediation Act 2023, administered by the Lagos Court of Arbitration under its arbitration rules in force when the arbitration starts. The seat is Lagos, the language is English, and the tribunal is a sole arbitrator agreed by us or, failing agreement within 21 days, appointed by the Lagos Court of Arbitration. The arbitration, its documents and the award are confidential, except as needed to enforce or challenge the award or as the law requires. Pickup pays the administrative fees of the Lagos Court of Arbitration and the arbitrator's fees. Each side pays its own lawyers' costs unless the arbitrator orders otherwise. You may opt out of arbitration by email to legal@pickupltd.com from the email address on your account, with the subject "Arbitration opt out", within 30 days of first accepting these Crew Terms. If you opt out, disputes go to the courts of Lagos State, and the rest of these Crew Terms is unaffected.
14.3 No class or representative claims. As far as the law allows, you and Pickup each bring claims only on an individual basis, and not as a claimant or class member in any class, group, collective or representative proceeding. If this clause is found unenforceable for a particular claim, that claim goes to the courts of Lagos State, not to a class or group arbitration.
14.4 What is not affected. Nothing in this clause 14 affects: any claim about your pay or engagement, which is between you and your Operator (clause 2.2); any matter within the exclusive jurisdiction of the National Industrial Court of Nigeria; a small claim in the small claims procedure of the Lagos State Magistrates' Courts; a complaint to a regulator; or an application to court for urgent interim relief.
14.5 Governing law. These Crew Terms are governed by the laws of the Federal Republic of Nigeria, as they apply in Lagos State.
14.6 Court process. Formal court process, such as an originating process, is served on Pickup as the rules of court require, at its registered office, whose full address is on the Corporate Affairs Commission's public register.
15. General
15.1 Changes. We may change these Crew Terms on at least 30 days' notice in the app and by email, or at once where the law, a regulator or safety requires it. You accept a new version in the app, as clause 1.3 describes. If you do not accept, you may close your crew account instead.
15.2 Severability. If any provision is invalid or unenforceable, it is changed to the minimum extent needed and the rest continue in force.
15.3 Entire agreement. These Crew Terms and the documents in clause 1.4 are the entire agreement between you and Pickup about your use of the Platform. Your engagement terms with your Operator are separate.
15.4 Notices. All notices are given by email or in the app. We give notices to you in the app or by email to the address on your account, and a notice to you is received when it is sent, unless we are told it was not delivered. Notices to Pickup go by email to legal@pickupltd.com, or for privacy matters to privacy@pickupltd.com, and take effect when received. Formal court process is served as clause 14.6 describes.
15.5 Survival. Clauses 2, 7.3, 7.5, 9, 13, 14 and 15 survive the end of your access to the Platform.
15.6 Bribery and sanctions. You must never offer, give, ask for or accept a bribe or improper payment in connection with a trip, including to or from a Guest, a Pickup employee, an Operator or any official. Report any request for one to legal@pickupltd.com. You must not use the Platform if you are subject to sanctions that apply to Pickup.
15.7 Transfer. You may not transfer your account or these Crew Terms to anyone. Pickup may transfer them to a successor to its business, on notice, without reducing your rights.
15.8 No waiver. If we do not enforce a right at once, we can still enforce it later.
15.9 Third parties. Only you and Pickup can enforce these Crew Terms. Your Operator's duties to you are set by your engagement with it.
15.10 Language. These Crew Terms are written in English, and the English version governs.
